Penalties for Driving While Ability Impaired

If charged with DWAI, you may face incarceration, license suspension, and fines. 

First Offense

A Fine of $300.00 – $500.00, up to 15 days in jail, and a mandatory 90-day license suspension.

Second Offense

A fine of $500.00 – $750.00, up to 30 days in jail, and a revoked license of at least six months. 

Third Offense

A fine of $10,000, permanent revocation of a license, and prison sentences of up to seven years.

Subsequent offenses include increased fines, license revocation, and probation. Repeat offenders may be faced with community service or Mandatory jail time.
